AmanziTel Privacy Policy

AmanziTel AB ("AmanziTel" or "we" or "us" or "our" or other similar pronouns) takes your privacy very seriously. Please read the following to learn more about our Privacy Policy ("Policy"). This Policy details how we receive, collect and use information in connection with our website, wiki, services, various mobile, tablet and PC applications (all of the foregoing, collectively, the "Services"). Collection of information in our licensed Applications can be turned off by You anytime.

1. Collection and Use of Information

Mobile, Tablet and PC Applications

When you install the Geoptima, Yelpz or any other application we developed we notify you via the various application stores that the application have access to quality, location, contacts, and transaction information of your call, messaging or browsing events. However the apps do not have access to and do not record the contents of you phone call, messaging or browser. When you register on our website or wiki, you will be asked to provide us your email address where you can be contacted and where login information are sent to.

We may collect and store the events generated by your device when you install our applications such as calls, messaging and browsing but never the contents of your call, messages or browser. By checking the “monitor events” check box you undeniably express your consent for us to collect information about your device and usage and have it stored in our servers. We maintain this information in order to better understand network behavior and trends (numbers of calls made by users, typical destinations, call duration, signal quality, etc.), detect potential outages and technical issues (this helps us notice things like a drop in call quality, low data throughput, etc.) and for public safety reasons.

We may collect your location information via GPS information on your device and identity of your device, however we do not collect information that identifies you personally. You may turn-off the collection of any information by unchecking the “monitor events” check box in the application settings. While the “monitor events” box is unchecked no information from your device will be collected or stored. If you wish to completely remove any information about your device stored by AmanziTel please send an email to optout@amanzitel.com proving your ownership of the device and desire to fully remove any stored information about your specific device.

All log analysis is done without your personally identifiable information. We do not use and do not publish your name or phone number or email address or a combination of your personal identifier. We may look into a specific log in response to a customer support request.

Audio calls and messages by users are transmitted directly from user to user or and we do not have any access or influence to such transmission, furthermore we do not intercept such transmission. In the event we make wiki, message boards and forums available to you (collectively, "Forums"), you will be solely responsible for the information and any other content you post on and through these Forums and should be aware that when you voluntarily disclose personal information (e.g., name, e-mail address, telephone number) on or through these Forums, such information is generally accessible to, and may be collected and used by, other users. You are encouraged to exercise discretion when providing personal information about yourself in and through Forums.

We may from time to time ask you to provide information about your experiences with our services and applications that will be used to measure and improve quality of our services and the services provided to you by your network operator. You are at no time under any obligation to provide any of such data through any surveys. Any and all information that are voluntarily submitted in feedback forms or any survey that you accept to take part in is used for the purposes of reviewing this feedback and improving the services we provide and the services provided to you by your network operator.

2. Sharing and Disclosure of Information

We do not rent, sell, or share any personal information about any user with any third parties. We may disclose information about your device or your usage of network services if we determine that for national security, law enforcement, or other issues of public importance that disclosure of information is necessary.

In order to provide you with better services we sometime may provide your usage statistics and perceive usage experience to your network operator or regulatory authority. However we do not collect and we do not disclose your personal information whatsoever.

3. Security

We take reasonable precaution to protect Personal Information, if any, from misuse, loss and unauthorized access. Although we cannot guarantee that Personal Information, if any, will not be subject to unauthorized access, we have physical, electronic, and procedural safeguards in place to protect Personal Information. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure.

4. Changes to Policy

From time to time, we may revise this Policy. We reserve the right to update or modify this Policy, or any other of our policies or practices, at any time with or without notice. We will post the revised Policy on our website, so that users can always be aware of what information we collect, how the information is used and under what circumstances such information may be disclosed. You agree to review the Policy periodically so that you are aware of any modifications. Your continued use of the applications or services indicates your agreement to any changes and signifies your agreement to the terms of our Policy. If you do not agree with these terms, you should not use our applications or services.

LICENSED APPLICATION END USER LICENSE AGREEMENT

AmanziTel AB, a subsidiary of DingLi Communications Corp. Ltd. ("AmanziTel" or "we" or "us" or "our" or other similar pronouns) offers users with mobile, tablet, laptop or desktop devices ("You") call, messaging and data monitoring ("Services") transacted through a licensed application (“Licensed Application") for mobile, tablet, laptop and desktop devices. Our Licensed Application is licensed, not sold, to You for use only under the terms of this license, unless a product or service is accompanied by a separate license agreement, in which case the terms of that separate license agreement will govern, subject to Your prior acceptance of that separate license agreement. We reserve all rights not expressly granted to You.

1. Scope of License

This license granted to You for our Licensed Application is limited to a non-transferable license to use the Licensed Application on any mobile, tablet, laptop or desktop device that You own or control and as permitted by the Usage Rules set forth in our Terms and Conditions (the “Usage Rules”). This license does not allow You to use the Licensed Application on any mobile device that You do not own or control, and You may not distribute or make the Licensed Application available over a network where it could be used by multiple mobile devices at the same time. You may not rent, lease, lend, sell, redistribute or sublicense the Licensed Application. You may not copy (except as expressly permitted by this license and the Usage Rules), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open sourced components included with the Licensed Application). Any attempt to do so is a violation of our rights. If You breach this restriction, You may be subject to prosecution and damages. The terms of the license will govern any upgrades provided by us that replace and/or supplement our Services, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.

2. Consent to Use of Data

We treat your privacy seriously and put utmost care to protect your privacy. You can find our privacy policy at http://www.amanzitel.com/pages/show/company/privacy. You agree that we may collect, temporarily store and use technical data, usage information and related information, including but not limited to technical information about Your device, your usage of your device system and application software, and peripherals, your location, that is gathered periodically or based on your service usage to facilitate the provision of software updates, product support, customer experience and other services to You (if any) related to the Licensed Application. We may use this information, as long as it is in a form that does not personally identify You, to improve our Services offered to You or to your network operator or to the regulatory body in your respective territory.

If you wish to completely remove any information about your device stored by AmanziTel please send an email to optout@amanzitel.com proving your ownership of the device and desire to fully remove any stored information about your specific device.

3. Termination

The license is effective until terminated by You or us. We will terminate your rights under this license without notice if You fail to comply with any term(s) of this license. Upon termination of the license, You shall cease all use of the Licensed Application, and destroy all copies, full or partial, of the Licensed Application.

4. Services

In the course of using the Licensed Application You may encounter content that may be deemed offensive, indecent, or objectionable. Nevertheless, You agree to use our Services at Your sole risk and we shall not have any liability to You for content that may be found to be offensive, indecent, or objectionable. You agree not to not exploit the Services in any unauthorized way whatsoever, including but not limited to, trespass or burdening network capacity. You further agree not to use our Services in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party, and that we are not in any way responsible for any such use by You, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions that You may receive as a result of using our Services.

We make no representation that our Services are available for use in any particular location. To the extent You choose to access our Services, You do so at Your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws. We reserve the right to change, suspend, remove, or disable access to our Services at any time without notice. In no event will we be liable for the removal of or disabling of access to our Services. We may also impose limits on the use of or access to our Services, in any case and without notice or liability. You should note that continued use of GPS running in the background can dramatically decrease battery life

5. NO WARRANTY

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR SERVICES ARE PROVIDED "AS IS" AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND SERVICES, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. WE DO NOT WARRANT AGAINST INTERFERENCE WITH YOUR USAGE OF THE LICENSED APPLICATION AND SERVICES OR THAT THE LICENSED APPLICATION AND SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE LICENSED APPLICATION OR SERVICES WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES CAUSE ANY DEFECTS, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

6. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event shall our total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty euros ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

You may not use or otherwise export or re-export the Licensed Application except as authorized by Swedish law and the laws of the jurisdiction in which the Licensed Application was obtained. You also agree that you will not use these products for any purposes prohibited by Swedish law.

7. Jurisdiction:

The laws of Sweden, excluding its conflicts of law rules, govern this license and your use of the Licensed Application. You expressly agree that the courts in Helsingborg, Sweden have exclusive jurisdiction over any claim or dispute with AmanziTel or relating in any way to your use of the Licensed Application. Your use of the Licensed Application may also be subject to other local, state, national, or international laws.

LICENSED APPLICATION END USER LICENSE AGREEMENT

Our Licensed Application is licensed, not sold, to You for use only under the terms of this license, unless a product or service is accompanied by a separate license agreement, in which case the terms of that separate license agreement will govern, subject to Your prior acceptance of that separate license agreement.
